loan w/o in 10/97--still calls

    My situation: I am being harrassed for a private student loan that was taken out in 10/89, and written off by the college in 10/97. This was never my debt--all my loans were federal, and I have paid on them faithfully. I keep getting calls from Lori Sweet with Williams-Fudge re this, and they have even went as far as to send me (twice) forms to sign that say I'll pay this loan, and the forms have my REAL (Other) loan info (balnce still due, SS#) etc... on them. They want me to consolidate the loans, but I swear that the one that they are trying to collect on is not mine. My college will not help me, and I've even went to see them in person.

    Any suggestions? Can these forms that have my other info on them be an invasion of .... well... something?

    What period were your legitimate loans from? Is the erroneous loan from the same period, and/or is it from the same college, or are there clear differences?

    They were from the same time frame and from the same college. What I do know is that I do have a federal loan that I pay on, and that the loan that I'm disputing is one from the college itself (not federal). I was told all of this when I went to get a car loan 3 years ago. I didn't even know it was on my report until then. And the CA just keeps calling, and calling, and then those forms. Isn't there a time limit thing for this since it was writen off almost 7 years ago? Or have I completely lost my mind? :)

    Get your credit reports. HARDCOPY, one from each of the three bureaus.

    Send the CA a limited cease and desist letter ("per the fair debt collection practices act, I'm invoking my right to be contacted solely by mail. You may not call me.").

    Then breathe a bit.

    Figure out why they think it's your debt. Make them validate. Make them get the original creditor to pull the promissory note -- and all the payment history.

    Etc.

    Make them work!

    Has either the college or the CA produced a loan application with your signature on it?
