DAMN! That was COLD! They probably wrote your account off and got recourse from that. At this point, they are toying with you. Did you offer to settle for the FULL AMOUNT in exchange for deletion? If so and they didn't go for that, then it's pretty much a lost cause unless you can come up with a plan B. I don't know what plan B would be. I don't know what to say but I'll tell you this, you don't want RMA on your back. Do a search on this board regarding them.
hmmm, I offered to pay the full amount. They were willing to report it as... "Settled for Full Amount" was 120 days late.
Well, actually, I applied for a mortgage and they are the only thing stopping me from getting a conventional loan. If they won't budge, I absolutely will NOT pay them a dime. It will be off my credit report in 1.5 years. If that is the case, I just won't try for a mortgage until all my bad credit is gone. The way they are acting, I could almost be certain that even if it is paid, I will NOT be able to have it removed because they will keep verifying it. Oh well, my loss=their loss I tried hard to pay the amount owed, they just wouldn't budge on the reporting.
from your other post it looks like when you picked up the phone and called RMA to settle Discover, they were gonna do a settled 120 days late, then hung up, and reported your sears charge off 120 days late,, hun,, but this discover is off in 1.5 yrs,, stop talking to them on the phone, write a letter, to them telling them,, you will settle but only if its deleted,,,,,, you are NEVER gonna get them to delete it, RMA is EQUIFAX,, although there is no law stating a Neg MUST be on report for 7yrs from charge off before 1998,,, only it can be there,, when they come back again, and say no delete,, well then how about this,,,, this debt is OUT OF SOL; you wont get a dime from me,, if you try to sue, Ill countersue,, take it or leave it, at the very very least, have it reported as PAID, and kill those 120 days, but you know if you apply for a mortgage over 150,000 your report from all 3 is your credit history since birth,,,,,,,, but you must show Mortgage lender its paid,,,,,,,, lots of luck,,,,,,,
I never called RMA to settle Discover, I called Discover direct. What's this about not being there for 7 years? I thought it was a law. Please tell me your sources for this information as well as the "report since birth" for a 150,000 home. This is the first I have heard of this and probably changes the situation.
No. They don't HAVE to keep in on there for 7 yrs. They'll just tell you that. Also don't you love how the person you're speaking with claims that you spoke w/ her before when you KNOW you didn't.
I thought he was saying that it would stay LONGER than 7 years. That there was no law prior to 1998 that says it has to be deleted after 7 years. I thought this was what he was saying. So there is a law right?
My understanding is that it can stay on a Maximum of 7 years but the creditor can delete it at any time OR change the status to something favorable. You just want to be careful that they don't fool with the dates to make the late pay look younger than it is. Not sure about those high dollar transactions posted in the other thread. Seems like those are indefinite.
