LTD pulled DH's CR 12/31 and twice 4/16. TU deleted one a few days ago as a duplicate. Anyway I didn't know who they were, so I sent a PP letter. A few days after that we get a dunning letter from them re a California Commerce charge off still in SOL. My PP letter crossed with their dunning letter. So, I sent a validation letter. DH received a CRRR from them that states they have closed the account in their office due to the C & D I sent. (I never-never have sent a C & D I think its too risky). Also, in regards to the PP - your credit agreement with your creditor allows the creditor or any agent working for that creditor in a collection capacity to view your report. This is just great! My luck Cali Comm will sue us now. Any suggestions????
Well, the thing I would want to find out now is if the CA bought the debt from CA Commerce or were they merely collecting on their behalf. If they bought it, they may sell it to another CA. If they were assigned, they probably are returning it back to CA Commerce, and now you have a chance to settle directly with them.
No, it wasn't sold. The letter said they were sending it back to CA Commerce. Over three years ago, we notified those morons that DH's new billing address was in the US. Started receiving bills. Then one day to my embarrassment I found out I couldn't charge on it. They had closed the account because they could not locate us. WTF? So, they charged us the annual fee, closed the account, and quit sending bills. No bill = no payment from jlynn.
As I'm sure you know, that last statement is what got you in this situation. That said, and no, I'm not lecturing, assuming it has been sent back to the oc, I agree as above, that you should send them a settlement offer of pay for deletion. If it's been 3 years, they may just be happy to get paid.
