Lurked long enough-need help! :)

    Hi everyone:
    I'm in the early stages of credit repair. After ignoring the bills and phone calls for far too long, I just decided to jump in and DO something: Last month, I disputed items as "not mine" on my CRs and sent out VOD letters to every CA listed. Yes, I should have done this the other way around, but I didn't know that then. :)

    I've registered with PG, myFICO, and CreditWatch, and have been reading and researching online almost to the point of obsession, and the waiting is so frustrating! :)

    With EX and TU, I was able to get several deletes - including a 1997 BK - and earlier this month I MIRACULOUSLY got a car loan despite my 560 TU. I have yet to receive VODs back from Midland Credit for a 2000 HH/ORCH account, Asset Acceptance for an 1999 Direct Merch, which are the two most glaring items on my CR.

    Midland sent me a letter saying that they would report the account as "in dispute" and requested copies of whatever info I had on the account (HUH?) I responded by telling them that the onus was on THEM to prove the debt, however, "in the interest of saving time and effort on both of our parts," I offered a settlement (for FULL deletion, of course!)

    Asset sent me a generic computer printout, so I wrote back telling them it wasn't sufficient VOD and made another request and the same settlement offer. I didn't hear from either - But then, Midland verifed the debt to the CRA (didn't report it as "disputed" either) and Asset pulled my CR last week, despite C&Ds to both.

    On 4/29 I sent both letters stating that they were in violation of the FDCPA and FCRA, and demanded that they remove the negative information within 7 days of the date of the letter (sent both CRRR and via fax) or else I would "pursue legal action." WHEW! Long story, huh? Sorry about that. My question is this:

    If I STILL don't hear from them, what EXACTLY should I do? I'd appreciate any feedback you can give me.

    Thanks for the response, Butch! I figure that's what I'll have to do, but I'm not sure how to go about everything.

    I mean, ARE they actually in violation by pulling my report despite the C&D (Asset) and failing to report the account's dispute status, yet verifying with the CRA? (Midland) I believe they are, but want to make sure I don't get caught out there.

    How do I proceed? Talk to me like I'm four - LOL!!

    Well, that's great news, but I need more detail on exactly what to do and how to do it. I read so many extensive directions for others, yet it seems no one here can offer me any suggestions.

    Can't ANYONE help me?

    Got to small clains court, file against them for violations of the FCRA, When you get your day in court, explain the FCRA to the judge, show him sections of it highlighted, and cite specific case law. Bring all of your CRRM green cards with you as well as past and current credit report print outs.

    It seems as if you want us to do it for you , we cannot. I suggest the search option of this board for further guidance.

    Although I'm VERY new at this, I'm also VERY aware that you guys cannot "do it for me" (who would ask such a thing, anyway?) I was simply asking the members of this board for feedback and guidance in order to ensure that I was proceeding in the proper manner, and not going off half-cocked. Short of an attorney, I thought who better to advise me than someone who has been through it already - Go figure, what was I thinking?

    For the record, it is rather disappointing to finally gather the courage to ask for help and have to practically beg for a response. So, your comment seems rather uncalled for.

    That said, I do appreciate that you (and others) did get back to me with truly useful information. Thank you for that.
