LVNV...can I sue them?

    Very long story short: Sears/CitiSears charge off; bought by LVNV Funding, LLC who through Northland Group Inc. settled with me on the debt in March 2007. February 2008, husband gets a civil summons from LVNV for the exact account we already paid. I provided the receipts of payment for the account showing it was settled and LVNV dropped the civil suit. I pulled my CR from all three agencies and LVNV is still showing the account status as "collection account. $xxxx.xx past due as of Feb. 2008. I disputed this with the CRA's and all LVNV did was verify the incorrect information with the CRA's. The CR status details state: This item was verified and updated on Feb. 2008.

    What do I do now to get this information accurate on my CR? Geez, they tried to sue me over a debt I already paid and now I can't even get them to report accurately on my CR! Help!!! Thanks so much,

    Sue them. You have violations of both the FDCPA and the FCRA, 1681s-2b, providing you have some damages.

    Quit wasting your time, get an attorney, and take care of it. You have viable causes of action and this is a dirty company.

    They're not easy to remove otherwise but, it can be done if you know what data fields to target.

    What kind of damages? Like when hubby went for a personal loan and LVNV showed on our CR saying we still owed them and the loan officer stated we would have to pay off LVNV as a debt consolidation? That was in December 2007. Funny thing is, the manager called yesterday to discuss another loan, and actually mentioned LVNV. Btw, the personal loan hubby got in Dec. 07 has a high interest rate. Is that what you mean by damages? Sorry for all the questions.

    Uh, yea. That is exactly what I mean about damages.

    I smell a summons going to South Carolina . . .

    thank you for answering Apex, I really appreciate your advice, and this forums wisdom. I'll be discussing this with hubby and I can pretty much tell you there will be a suit filed against LVNV. I'll keep you updated on our progress. Again, thanks for pointing the way.
