Macys...Grrrr

    I'm usually good at resisting store credit offers (Do you want to save _% on your purchase today?), but in 06/05 I fell victim to Macys. I was buying DH a bunch of Tommy Bahama and 15% off was looking pretty good. When I received my bill in July, I PIF via BOA Billpay. End of story. Well, I got a statement in the mail saying my account was past due. I called CS and they made me fax a copy of my pymt info and assured me that no negative info would be reported to CRAs. Made another purhase in 08/05, upon receipt of statement, PIF again via BOA. Ditto on Macys action. I again had to fax proof that I paid this bill. I closed the account at this time and again was assured no negative info to CRAs. In November I receive a letter saying my account is still past due. I call up and tell them the account was PIF and closed. This time they decide to cross reference it with the Visa side of things (which I never used) and say that the payments were posting to that account. WTH? Anyway, I am assured for the third time that all is good and no negative info to CRAs.

    With the incompentence I dealt with from July through November, it did not surprise me when I pulled my CRAs and found negative entries on both TU and EQU.

    I sent their credit dept. a letter, with all of my proof AGAIN, demanding that the negative marks be removed. I closed by saying that if it wasn't taken care of immediately, I would take legal action against them.

    My question is, if they blow me off, what part of FCRA can I cite as the reason and how much $ can I demand from them, if any? This is totally about principle, but the cash would be nice, too. :)

    Have you keep all your statements and documentation showing the exact dates payments were made.?.. If so, I would send them copys of when the payments were made and the fax info you had to send to them proving they were made.Names of the employess you talked with if you got them..
    Send a Dispute letter or Debt Validation to the CRA about the entrys.Send it CMRR..They have to investigate the accuracy of all items..
    2nd. Write the Credit card/store Let them know the whole story in writing and that you have the proof that they made serious mistakes.That you have the documentation to prove payment was made on time and in Full, and if its not corrected you will take appropriate action against them per FCRA. Send it CMRR. If it is still not corrected You maybe able to demand 1k per entry on your CR.
    Be tough but make sure you have your paper trail.

    I definitely have the paper trail. I am going to stay on them like stink on a monkey!
