You stated on another post that you disputed information that creditors had listed along with "included in BK" on your cra's. Did you do this through the CRA's or through the creditors themselves? I filed chapt 7 3/2001. I have Discover that's stating "discharged in BK/ Account Charged Off" Charged off 8.2001!!!! And Citibank stating "discharged in BK/Collection Account" They're saying they have me in collections from 4-2001 thru 6-2001. This is the time of the Automatic Stay and the exact time of my bankruptcy. Isn't that like soooo wrong????? Help! Need your expertise!
I wouldn't say I'm an expert but..... I disputed throught the credit reporting agencies. I simply said this account was never charged off. I guess that is the method the creditors use once you file, but in my opinion, they can't ding you twice for the same thing. That would mean they could also start adding 30 60 etc days late from the date you file until it gets discharged. They can't do that either and suprisingly, none of them tried it. I've been told that it doesn't matter if it says both or not but I believe it would. Almost all of them came back with the charged off part removed or the entire account deleted (even better!!!) . I have maybe 3-4 more to do (I stagger them).
That's EXACTLY what FUSA is doing to me! They're saying I was 120 days late and what they're counting is from March until June. This is the whole time of my BK case. (Filed 3-22-01) It's totally not fair! I disputed with Experian and they did change my info to say Included in Bk, but they left the "late" dates on there. I guess I'll try it online this time and see if it can come off. I did get FUSA deleted off of TU report. (didn't ask, just wanted it to say Incl. in BK) I guess they didn't verify in time. Hey I'll take it! Have you noticed them showing back up later with the same "wrong" info? How far apart do you dispute? I appreciate all your help! I'll give it a shot online w/experian and see what happens.
FUSA is doing this to me also. I have written a letter to them as well as a demand letter cc: to my attorney on the demand letter. I am due to get a new Experian from disputes by the end of the month. So far no written reply from them other than the first PFB letter I sent. In fact FUSA is reporting late and erroneous BK filing info after the BK was discharged. I will see what my udate yields. I disputed this account in an earlier dispute through Experian and it came back verified. I don't hold high expectations from contacting FUSA directly, but maybe my attorney will if my update is still incorrect. I had no idea, though that they cannot include the time while the automatic stay is in effect. Although it makes total sense. Right now FUSA is reporting 180 days late (this is three months since the discharge), with them going reporting lates through the BK process it comes out to 120 days. If they are not supposed to count the time through the BK process, then there should only be a 30 day late as I filed after I was only a month late. This then means I have an even stronger case.
Hey DLO, that's what I THINK should be the case as far as them using the time of your case to access their late dates. I honestly don't know if they can do it or not. I asked on a board that an attorney sometimes answers on, but I'm not expecting much help there. Matter of fact, I just remembered about Askme.com too. I'll ask over there. I wish there was something "in writing" that we could cite to make them stop and that we could use to back this up because it's such a slap in the face. I wasn't late prior to filing, other creditors have me listed as "Discharged in BK/Never late". I know they're just screwing with us. I also know that filing Bankruptcy sucks too, but it's the principle of the thing seeing them claim I was late in March, April, May and June!!! Ugghhhh! I should get results back by the end of the month also. Keep posting!!! Somehow, maybe we can figure something out. heehee, anyone know an attorney who might know if we have a leg to stand on??
Wow, I must have really lucked out. None of them reported me 30, 60 ..... days late. I checked CreditExpert, it shows I have 15 negative accounts (I did have 18 before). 12 of them show Included in Bankruptcy/Never Late. I too was never late until I filed. I had a major incident that forced me to file, I had never fallen behind before that. The other 3 do still show as charged off. However on the first page of Credit Expert is says "Public Records - 1" "Late payments, charge-offs, accounts in collection):-0" So apparently Credit Expert is not picking those up as actual charge-offs. Anyway,, I would definately dispute those as saying you were never late and/or account was never charged off prior to b/k. I'll check around for something quotable.
