Making arrangement w/ CO

    Hey everybody...I've just joined; however I've been lurking and researching for about six months now. So I think I'm still considered a newbie. :-/

    I have a CO that did verify the debt and is now attempting to collect from me. They want a higher monthly payment than what I desire to pay and they want it via electronic debit from my checking or savings. My question is if I send them payments via cashiers check for a lower amount than they said I "must" pay, can they still file a judgment against me although they are threatening to do so if I don't agree w/ their arrangements?

    Yes, they can still sue you, and in some states by paying something you may actually extend the time they have to sue you.

    How old is this debt?

    Oh joy. It's three years old.

    While they still may be able to sue - they cannot dictate how any future payments are to be made.
    Stick to money orders or cashier checks. Once you pay with your own check they will have your banking information, and can rob you blind.
