    PS:
*What I meant by this is if they come to your house and take aunt Frans bookcase they will be in a heap of trouble with aunt Fran.
So every thing there belongs to her or uncle Walter or cousin George or some such.

First of all, if it came in the front door, it probably will not be repossessed.

Second, even if it doesn't fit in the front door, there are ways of making it uninviting for a repossessor. Go to my Thread:

    http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=390933#post390933

If a repossessor comes to your door and wants to come in, ask if he has a Court Order, called a Writ of Replevin. If he doesn't ask him to get off your property immediately. If he doesn't call the police to have him escorted off your property.

Thank you - I think it is unlikely that they would show up at my door - the three cards that are behind were not used for major consumer purchases - as I said, I don't really own anything big that I bought recently. I'm don't have any store cards that I used for tvs or appliances or anything like that. And I haven't used any of my cards in a long long time - I think maybe I bought a few christmas presents last year (less than $300) and stayed in a hotel this summer, but that's it.

I will take your posts seriously though, and prepare myself.

    Thanks!

My understanding of judgement proof is they cannot touch pensions or social security My question is we have a home that we owe less on then the 16,000 in question. Can they get a judgement against our home, and if so, what form? A lien against the house when it is sold sometime in the future, or could we be forced to sell our home to pay the judgement?

The judgement become a lien automatically in most states. And YES, a lienholder CAN foreclose by paying off all prior liens. Can they force you to sell? No, but they can force a sale without your consent.

I don't understand. They cannot force us to sell our home, but they can force a sale without our consent. Can you explain further. Thanks

It's called FORECLOSURE - any lienholder can do it.

I would be really interested in your website, or others advise regarding judgments and keeping creditors from garnishing wages, accounts, etc.

    Great info!

    Thanks.
