Marie thanks for answering my question about the debt going back to the original creditor. On my report it shows the collection agency trade line, not the original from Cingular. When they (CA)send the debt back to the O.C. , will the tradeline be deleted by them (CA)? What if Cingular sends the debt to another collection agency? Will I then have 2 negative tradelines for the same debt? Is there anything that covers us from having the debt sold off 20 times and it appearing on my report that many times I intend to pay the debt off as soon as it goes back to the OC. Any problems with this or ostrategies? I just don't want to risk another collection entry on my report. It's only for $190.00
As I said before, I would hold off on paying the debt to the oc. 1. Send a nutcase letter outlining their violations of the fdcpa and fcra. If the ca is "sending it back to the oc" it means they can't validate it. Thus, it should already be removed from your reports. Again, get copies of those reports. Is there a notation of "consumer disputes" on the collection account? If not, that's another fcra violation. 2. Send a copy of this ca nutcase letter to the oc with a cover letter stating you're holding Cingular responsible for their ca violations of the law. See what happens. 3. In theory... the oc could send the account out... EXCEPT that the first collection agency can't validate. This means the oc really can't continue collection activity until validation. The validation would now come from the oc since the ca is bowing out. If the oc send you nothing in the next 30 days or so.. you can send a followup letter confirming that they are no longer pursuing, selling, or attempting to collect on the debt... After you let them know you have them on multiple violations thanks to their ca... you can see what they offer to you. But I would NOT pay it just because it goes back to Cingular. If you do pay it as a settlement agreement, I wouldn't go more than 50% with a written agreement that they won't report this debt in any way to any cra. And if you ever do decide to pay it, please don't use a personal check... boy, if that doesn't confirm a debt is yours...
