I need to know... when I send a procedural description to TU...do I need to add about my previous Validations w/the CA's and my intent to file a lawsuit? Or do I wait and get the procedural description form TU....THEN... send them a Notice of how I sent a validation letter w/out a response followed by a Estoppel letter. And how can they verify it etc... etc.. If they don't remove it I will sue..?? I'm lost... Do I add it all in one letter NOW.. or break it up into two letter? Thanks
this is easy. Go ahead and just ask for the procedural description from TU. Later you'll send a copy of all the other letters to them.. but for now, send something like this: Your Name 123 Your Street Address Your City, ST 01234 Big Credit Bureau Their Street Address Some City, ST 56789 1/9/2002 Dear jerks, This letter is a formal request for the description of the procedures used to determine the accuracy and completeness of the disputed information, including the business name, address, and telephone number of any furnisher of information contacted in connection with this re-investigation. I am disappointed that you have failed to maintain reasonable procedures to assure complete accuracy in the information you publish, and insist you comply with the law by providing the requested information within the 15 days allowed. For your benefit I will restate the relevant dispute: CREDITOR AGENCY, acct. 123-34567-ABC As already stated, the listed item is inaccurate and incomplete, and is a very serious error in reporting. Please supply a corrected credit profile to all creditors who have received a copy within the last 6 months, or the last 2 years for employment purposes. Sincerely, your signature Your Name SSN# 123-45-6789 Modify it a bit with your words so it's not so form letter ish... if you had more than one dispute, include them all. You want to restate them so they have another oppy to delete if they so choose. Send it certified return receipt requested. You want that little green card back proving they got it. then wait 20 days or so and we'll proceed. expect to get nothing. Thank You I wasn't sure If I needed to send them copies of my letters and etc.. NOW.. or wait until I send something like this letter. I've had so many opinions thrown at me.. no problem. Better to have a shotgun approach and get them on several issues than to reveal your hand prematurely. Like poker. they're really pretty easy. So many foulups... so little lawsuit time I may consider becoming a lawyer. My atty told me I should.
