Hi, newbie here. I have this annoying guy from Marquette finance (our car is financed there) who calls averyday, twice a day every time we are past the 15th of the month due date on the car payment, he quite rude actually. We have never been 30 days or more late, but occassionally go past the 15th of the month due date. I asked him politely to stop calling and being so rude, but he says that it's company policy to call.. My question is this, can I legally have him stop calling when we are not even 30 days over due?? I saw something similar saying that debt collectors have to if you request it in writing, but what about the creditors??
Original Creditors are not debt collectors and are not bound by the requirements of the FDCPA although some state laws may have such requirements. He might be right when he says it's company policy to call, after all they are looking out for their collateral
