Marshal Levys

    Would anyone know how Marshal Levys work? I live in NYC and I have two default judgments I'm trying to get vacated and when I went to file the paperwork, the County Clerk office asked for the notice from the Marshal stating that my monies were seized from my accounts. I told them that I never received notice from the Marshal' s office. The Clerk's face dropped and she said "What?!" I only received a letter from one of my banks that the monies were debited from one of my accounts. Of course, it is not the bank's job to send me proof of the notice from the Marshal but who is supposed to notify me? The Marshal's office or the CA who got a default judgment against me? How can I get the information on what Marshal office seized my account on the CA's behalf. Why would the courts need that information?

    I was never served. On the first judgment of approx. $4000, I sent a validation letter and the response was a lien placed on my bank acccounts. The second judgment for about approx. $6000, I was on a payment plan and lost my job. I informed them but they went ahead and got a judgment which is within their rights. When I went to file papers to have my cases restored to the calandar, the County Clerk asked about any levys. I told her that the bank informed me that they debited monies from my account per a Marshal's Levy. I never received any notification from any Marshal. I guess it is needed for court records.

    Since you weren't served on either judgment this is legal grounds to get both of them vacated.
    Have you been to the court house and gotten all of the paper work on them from the court?

    Who is Marshal Levys

    Never heard of this company ?

    It is not a company. I was just asking about how people are notified about seizures on their accounts from the Marshals office in the city they reside in. I was served on one case but I wasn't served on the other. Isn't there a certain type of hearing I can request for the CA to prove that I was served? What will happen if the CA doesn't show up to court? Will both cases be dismissed?

    Cvil Practice Law and Rules (NYSCPLR)
    Article 52 - Enforcement of Money Judgements

    maybe that will help answer your question

    I'm from Ohio.
    We have State police
    County Sherriffs and
    City Police Departments ,but no marshals.
    I have no idea what a marshal is or does in N.Y.

    Marshals are mayoral appointees - not paid employees of the City of New York - who earn income by performing tasks for New York City - such as carrying out evictions, towing cars, seizing property of people who fail to pay their debts and collecting money judgements for the New York Civil Court and the New York State Supreme Court,
    The city's 43 marshals are regulated by the DOI
    (Department of Invrestigations)
