    How can they charge a late fee for being late on ANOTHER ACCOUNT? I assume you mean with another bank, not another account with them. Even at that, it's ludicrous.

    We need to all write to our Senators and Representatives, as well as those on the appropriate committees (I assume the Banking Committee, I don't know what else). You can go to congress.gov and it will give you a list of all the committees and who is on them.

    I'm not sure how many people visit this site every day/month/year but it seems to me if we all got together and started a e-petition to get SOMEONE to realize what a joke the credit situation in the US is then legislation and guidence would have be initiated. I can't believe that no one out there with the power to change the system cares. I don't have all the answers but I realize that credit bureaus and lending departments need to have some accountability for not following the "rules", and those "rules" need to be FIRMLY established.

    Most recent MBNA amendments to my Account Agreement:

    Effective with Advances that post to your account on or after April 1 2003, we will assess a Transaction Fee (FINANCE CHARGE) equal to 5% of the US Dollar amount of each such Advance you obtain, including access checks, balance transfers, and direct deposits (Minimum Fee $15, Maximum Fee $99).

    Effective April 1 2003 a Late Fee if the Total Minimum Payment Due shown on your monthly statement is not received by us on or before its Payment Due date. The amount of your late fee will vary based on your total outstanding balance as follows:

    $100 or less = $15
    $100 to $1000 = $29
    more than $1000 = $39

    Effective the first day of the billing cycle following your April 2003 statement Closing Date, and Overlimit Fee if your total outstanding balance exceeds your credit limit on the Closing Date of billing cycle, eve if fees or finance charges assessed by us cause your total outstanding balance to exceed your credit limit; an Overlimit Fee is assessed to your account as of the day of the billing cycle that your total outstanding balance exceeds your credit limit. The amount of the Overlimit Fee is based on the amount of your total outstanding balance as follows:

    $500 or less = $15
    $500 to $1000 = $29
    more than $1000 = $39

    Effective April 1 2003 the Returned Payment Fee will be $39, if a check submitted as payment on your account is returned for insufficient funds or for any other reason even if the check is paid upon subsequent presentment.

    Effective April 1 2003 the Returned Check Fee will be $39, if we return an access check unpaid for any reason even if the check is paid upon subsequent presentment.

    Do I need to mention that I needed a magnifying glass just to read the amendments?

    It's a $99 fee on BT to a card that has a %14.99 APR. According to MBNA they can't go any lower on this particular platinum card. I won't even comment on that, okay?

    You are RIGHT! I have never actually looked to hard for it but I just went through MBNA Net Access web site and could not find one email addy listed on it.

    So I just got off the phone with MBNA. I spoke to three persons. Their explanation is that their system pulled my credit report automatically and BY MISTAKE. It is set-up to pull credit report on those customers with high balances, so the reps get the whole picture of high-risk customers when they are calling for any reason. I said my balance is $7. Am I high risk customer ??? They said I am not and again that their system pulled my report BY MISTAKE. I asked them to remove it. They said it's not possible. I asked them to lower my APR to 8.99. They said it's not possible. So basically I've been randomly choosed for hard inq. without any good reason. What a load of crap from MBNA.
    I asked is it possible to close the account ??? They said yes but don't do it because of such great benefits that I have as MBNA cardholder.
    Yeah right....
    I think I am going to close it.

    Youshoudl have received my e-mail by now. If these were the people you spoke with, that's a shame.

    Unfortunatelty, in the card member agreement, an issuer can pull a hard inquiry whenever they want as long as the account is open. So, while MBNA actions are unjustified, they are permissible. :-(

    I would contact the CRA and demand that they recode that inquiry to an account review. Escalate as high as you can to get that done.

    I would close the account *only* if your score won't be hurt by that action. Otherwise, keep it open and charge $1.00 per month every month. I would also write MBNA executive offices with CCs to the FTC, BBB, and your state attorney general.

    What they are doing is greed. If a customer with a high balance feels the need to ask for a rate reduction, by dinging the report with a hard inquiry, MBNA reduces the chance that the customer will be able to open an account elsewhere.

    Don't this conflict with the consumer laws regarding PP.
    If so it's not enforceable even though it may be in the agreement.

    I agree. That's why I encouraged Platinum to tell the VP why he/she was closing the account.

    The VP was not available today. But I hope I'll get in touch with her as well before I close the account. It is $20.000 credit line, never late. If I don't get anything as compensation I'll gladly ask the VP to close the account. Without that account my utilization is going to be around 17%. I still have another $65.000 available on my other CC's.

    Platinum, give us an update after you talk to the VP please.

    We have a $25,000 line of credit on that Platinum Plus and you may feel free to tell the VP that another customer will be closing her cc account with them within the next week.

    When a company pulls your credit bureau for an APR (permissable reason: assessment of risk in an existing relationship) it is a soft inquiry, but will appear as a hard until it gets purged at the end of the month. This happens with all of your cards.

    And they are not pulling your credit report to drop your score. That's just plain stupid.

    I recently spoke with a supervisor at MBNA and found out that they do have 7.99% on new accounts, but it's a special offer and not available on existing balances (ie HBO and digital cable/cable modem offered me 6 months at $19.95 the day after I signed up at $59.95/month) and said it was a special offer. Makes sense. They do sometimes offer 8.99 on existing accounts, but you typically have to have a small balance and excellent history, scores, etc. 9.99 is the best they offer in standard circumstances.
