I received a 2nd notice of arbitration from Asset Accpt. on Friday. Basically stating that I have 14 days from the date on the letter to respond in writing to NAF or a judgement will be filed against me. I am scared because I can't afford to have my wages garnished. What do I do now? I looked back at an old credit report and I know for a fact that I closed the account back in 97 or 98. SOL is 4 yrs in Ohio, would be up this year, but it looks like they have moved the month up over time. I don't have any forms or documentation from 1995 to support anything when I send a response.
Have you sent them a validation letter yet? Have you gone back to the original creditor to see what month this went delinquent?
No, I haven't sent validation. And looking at my old CR from 2000 it went dlq 5/2000 on EFX and 12/00 on TU & XPN. What will VAL do at this point? I have until the 24th to respond to NAF. Do I send VAL to CA or NAF?
Find out EXACTLY when you closed the account. If the SOL is a defense, respond to the NAF with an expired SOL defense. Send a validation letter to AA requesting their "proof" this is your account.
I called the last 3 CA's and all of them claim that they don't have any info before 2000. I called MBNA and they claim the same thing. Through their automated line I did find out that my last payment was (or so they claim) was $29 on 3/13/00. I don't recall such a payment. Either way, SOL is coming up. Here is what my TU states: On my 1999 TU Credit Report it reads: MBNA #123212232145 ACCOUNT CLOSED BY CONSUMER Updated: 6/99 Opened: 1/96 There is no closed info here. Bal: $1082 Most Owed: $1082 Status as of 6/99: paid or paying as agreed On my 2004 TU it reads: MBNA #123212232145 ACCOUNT CLOSED BY CONSUMER Updated: 12/00 Opened: 1/96 Paid off 3/00 Bal: $0 Most Owed: $1766 Status as of 3/00 Charged off as bad debt
