MBNA still has not sent anything!

    I still have not received anything from MBNA regarding the account that they opened in my name but sent card to out of state address. I have contacted every Credit Bureau to let them know that it is not my account. I need a letter to send MBNA to delete from my CR. Is there one on the board? I know about the nutcase letter but that is for collection not the actual credit card. Please help! I can even thing good anymore. We have never had any problems like this. Our credit cards are beginning to raise our rates and then we were denied by another company and I am sure it is because of this account with over 16,600 past due. I do not intend to pay for something that I did not know about until the account was about 8 months old. I feel this company should have checked my address and contacted me before opening the account. Help, PLEASE!

    Have you tried contacting the consumer affairs division of your State?

    dont feel bad took me 3 weeks to get my card from them :) (after i converted).. They are slow mailers

    I guess I did not make my self clear on this. This is a card that we did not apply for. MBNA opened it using our CR but not checking the address. We have lived in Texas for 20+ years at the same address. They allowed someone to steal our identity and now they want us to pay over 16,000 that we knew nothing about untill Feb. They opened the account in 5/01 and in two months the card had been maxed out at 15,500. I am so confused about what to do, I never dreamed it was so easy to have this happen. Think about all the people who have your SS#. That was what was used, the birthday was not correct or the address but still after pulling the credit report, MBNA still mailed the card to an address that was not on our credit report. Then to make things worse that address was put on the credit report so there may be more cards out there that we did not apply for or have use of. Our credit cards are always paid in full every month. I feel so violated, like I have been raped! It had been sereral years since I checked our CR but I had not had a reason until I got the first call from MBNA in Feb. I guess you need to check it every month and let the credit bureaus make money off of things like this.

    CONTACT THE FRAUD DEPARTMENTS OF THE THREE MAJOR CREDIT BUREAUS
    Call the credit bureaus. Have a fraud alert placed in all three of your credit files. Then order all three of your reports. This should be free because you are the victim of fraud. Experian's alert lasts 90 days and prevents you or anyone pretending to be you from viewing your report online. You may need to extend your alerts. Look closely at all three credit reports. Check that your address and phone number are correct. Look to see if any new accounts that you are not aware of have been opened recently.

    I have notified all of the credit bureaus. I have fraud alerts on them all. What I need is get MBNA to delete this from my file. It is not my account but it came back verified by experian. I don't know how when the card was sent to an address that I have never heard of. I am still trying to get MBNA to sent me something that will prove it is mine. I know they can't because I have never had their card. They just want me to pay the bill. How would you like to have to pay a bill that is not yours? I feel the credit card company made a bad mistake by not doing some checking before just sending a card out. Most of our cards all have to activated from our home phone number before they can be used. I know MBNA had our correct address and phone # because they pulled all three credit report before they opened the account. I could see how this could happen if they had not pulled the report. All our reports and the same address and phone number on them. Of course now, the address that they sent the card to shows up but I think I have got that taken off.

    Have you tried calling MBNA, specifically asking to speak with their fraud/security dept.?

    1 FILE A REPORT WITH THE LOCAL POLICE AND GET A COPY OF THE REPORT
    You want to file a police report so you have proof their was a identity theft problem. The easiest thing is to call you local police department. They may not want to take a report but under the law they have to.

    2 CONSIDER FILING A VICTIM STATEMENT WITH EACH CREDIT BUREAU
    You can file a victims statement that will stay on your report for seven years asking people to call you before granting credit. You need to do this in writing. Say "Someone has been fraudulently applying for credit in my name. Call my at XXX-XXX-XXXX to verify all applications for credit". This will make it difficult to get instant credit but you could get a cell phone and have the phone number listed in the three credit bureau files changed to the cell phone number.

    3 FILL OUT A ID THEFT AFFIDAVIT
    A new standardized form was made available by the FTC in February 2002. The purpose of this form is to not become legally responsible for debts that were in cured from identity theft where a new account was established in your name. This is a new form and not all institutions will accept it, so call them first and ask if they will accept it before you fill it out.
    You can download the form from the following link. You will need to fill out a separate copy of this form for each new account that has been fraudulently established in your name and have the form notarized. You bank or credit union should be able to notarize the form for free. Then send copies of the forms, not the originals, to each company. Send the forms certified mail/return receipt requested. Keep the original in a file folder and hang on to them permanently. When you get your green cards back, staple it to the originals.

    Call the social security administration and let them know someone has used your social security number for fraudulent purposes.

    Yes, I called the fraud dept. of MBNA. Over a month ago they said they would send an affidavit of me to sign but I still have not received it. I guess they sent it to the out of state address. They have been no help at all. All they want is for me to pay what they allowed to be charged. I don't know why it is my responsibilty. I did not have a card from them. I guess I need a good lawyer to sue the opants off of them for all the stress that we have been put under. Have never been through anything like this. It is hard enough trying to pay my own bills, farming is not that great right now. I need to be worrying about that instead of this mess.

    Well you might try calling MBNA at 1-800-421-2110, again and asking for a supervisor. Ask them if you can use the standard affidavit form or must you use theirs. If they want you to use theirs, ask them if they can e-mail it to you wile you are on the phone or mail it to you.

    I would also send MBNA a certified / return recite requested letter stating that the account if not yours and that you need the affidavit form.

    In any case, once you get the affidavit done and get a copy of your police report, you are ready to send three letters to the three credit bureaus. State that you have been a victim of identity theft and that the account is not yours. State that you are disputing the account. Ask that the account be removed and that they send you a new copy of your credit report.

    If you don't get satisfaction, I would a second stronger letter to the three credit bureaus with a cc copy to the FTC.

    If that fails to work, send a third letter, threatening to sue the three credit bureaus.
