I live in Texas. I've got a debt with MBNA 120 days late. They won't work a hardship plan like the other creditors did. Most did 5 years 0%. Received a letter in the mail first from Advanced Call Center Technologies. I sent a CMRRR limited CD and DV letter. No response and no more calls. Almost one month later, I get a letter from Wolpoff & Abramson. I was about to send them the same thing when I noticed that the letter said to pay MBNA not W&A. I looked back in my file and saw where Advanced CCT read the same way...to send payment to MBNA. They both had the mini miranda. My question is was I wrong to send a limited CD and DV to the first CA? Were they actually CA's if they were asking for payment to be sent to MBNA? Do I now send a limited CD and DV to W&A? Was this an illegal transfer of a disputed debt or not if this is actually the OC? Do I attempt again to get on some sort of hardship plan with MBNA? I've been reading and searching all day on all the credit boards and hate to drive you experts crazy but.....help please Thanks!!!!!!!!!!!!!!!!!!!!! Kim
In this case, the CAs are the firms you mentioned. They are working on an "agent" basis, in other words they did not purchase the debt from MBNA. They are merely the outsourced collection service. Your best bet would be to send the same letters to both MBNA and the firms contacting you. I am suprised MBNA would not do a workout plan with you. Generally they will do something. But for the sake of your credit reports, you'd be better off if you can avoid going to a "Charge Off" status, and keep it at 120 days. So, send MBNA some sort of minimum payment. I know others will argue that this moves the date of 1st deliquency, but 7 years from now is a long time. In summary, make some sort of payment to hold off the "Charge Off" status. Send (in writing, CMRRR) a proposed pay off plan to MBNA. Also, keep trying to "move up the ladder" in speaking with someone at MBNA. Get to a real decision maker who can approve your proposed payoff plan. I don't think you'll get five years @ 0%, but make the best deal you can. Good Luck....
