I recently found out MCM had purchased a 2002 account (closed in 2003) from FNBM (Marin) and posted it on my CR. I subsequently disputed with the CRA and sent them a DV letter in September of 2008. They sent me a response asking that I provide records that showed I owe them this debt in October of 2008. I sent them another letter in October of 2008 telling them "They", not "I" had to validate the debt and they responded by offering me a payment plan. In the meantime, they have continued to report this 'debt' to the CRAs as recently as 12/2008. Not to mention that the dispute with the CAs came back as verified. The so-called OC is not listed anywhere on my CRs either. Apparently, this is the MO of MCM and I need help stopping them from doing any further damage to my Credit.
Sounds like a case of continued collection without verification. If you sent your letter within 30 days of first contact (e.g. when they sent you a letter, called you on the phone, or you saw the entry for the first time), then you have a good chance of winning an FDCPA suit against them. The bad news is that you have to file a lawsuit for this to mean anything.
Time to institute a civil action. Be advised that MCM, and Encore Receiveables, corporate counsel is located in Mississippi of all places and they are cheap pre-discovery.
