I'm just being billed for 1999 from a CA. I know I paid the bill. Is the burden of proof on me after 5 years? Would the SOL matter in this case? I've been dealing with this CA for over a year on another bill and this is the first they are mentioning it to me. They said they will not investigate it until I can prove I paid it off. Any info would be appreciated.
LOL, then they better read the FDCPA again, they don't get to decide when they are going to investigate. Have you sent a dispute letter to them?
I told them they were in violation of the Fair Debt Act, when they took my 2/04 payment and applied it to this 1999 bill. Then they "corrected" their error. I told them I was'nt paying the 5 yr old bill. Should I send a dispute letter as well? This CA is on my last nerve. They don't credit half my payments, this is why I do not trust them when they say I owe them from 5 years ago.
Sorry, I'm confused too. LOL There are 2 accounts according to them and one according to me. The agreement is a hospital bill that I've been paying on for a year, it's just about paid off. They increased the balance and after much arguing they sent me an email showing me that they took my payment and applied it to the 1999 bill. This was how I learned that this bill still existed. When I saw what they did I said I'm not re-paying this bill. That's when he said he will not do any investigating on it until I prove I paid it. I paid the CA back in 1999 so the doctor has no record of payment. I have complained to the local BBB, Attorney General and the Federal Trade Commission. I will not pay them twice for the same bill, is there anything else I can do? My mistake, I didn't realize I had to keep receipts for everything from that far back. Hope this makes sense.
