A CA called me at work a few weeks back about a supposed credit card account with them. I sent them a validation letter. About two weeks later a different CA with the same address sends me "validation" for a medical bill they have of mine. Their validation was their printout of what they say I owe. A few days ago I got a printout that appears was sent from the Dr. to the CA which shows the date of services and all the "procedures" that were billed. My question is, did the Dr. violate the HIPPA law by sending a printout to the CA that contains information on procedures I had performed?
Technically yes they violated HIPAA. Pushing the argument is not so easy. Good News: There's a movement beginning to emerge in Congress to employ a private right of action for a consumer against HIPAA violators. So I take it this CA (#1) has TWO accounts for you. First, they have failed to provide information concerning your dispute. Sending a VAL. on something which has nothing to do with the issue you disputed is completely non responsive. Second, what they did provide isn't sufficient. A CA may not consult with their computer screen to substantiate a debt. Have you disputed anything to the CRA's? And you have never disputed the medical?
So wouldn't I be able to use the HIPPA payoff/letter to get this removed? I have it in black and white straight from the dr. to the CA and it very specifically names all the "tests" and "procedures" that were done.... Never disputed the med and the other c.c. account hasn't been disputed recently. When it was it was about a year ago came back as verified and I then got caught up in some personal things for awhile so I never followed up on any of it. At the time this CA did not have the account though. The CA contacted me about the 1 account and I sent a request for val. That is how I found out about the 2nd when they sent me validation for a totally different account. Yes, they are two different accounts for two different things.
