    Scenario: A old medical bill that consumer thought had been handled by their insurance company wasn't. Now a collection agency has the account and wants them to pay. Consumer asked name of provider and date of service. Once they got this information they called insurance company to determine if the claim was sent. Insurance companies response was no. It has now been 3 years and the ins. comp. won't pay because their statue of limitations, and the provider is saying it's the consumer's debt.

    Dose the medical provider have a statue of limitations as to the time period they have to submit the claim?

    Medical providers file claims as a service, they are not required to do so. It is up to the guarantor to make sure the bills are submitted.

    Agreeing with Gib, but add to, was it an HMO?

    Check your state law regarding the type of insurance you had at the time.
