Hi everyone! I filed BK last year and included a medical bill for 96.00. I just got a copy of my credit report and it is showing a collection agency for this bill. I filed 2/04, discharged 6/04. The collection reported 8/2004 after the OC was notified of the BK. I refuse to ever speak to a CA esp with medical. I called the OC this morning they said that they sold the account. That they could not talk to me about it. She kept screaming that she had a contract with the agency. I did not know they could sell medical. I do want to mention that the date of service was prior to the 4/2003 change in Hippa on 2/2002. I told her that also. They are reporting a debt that does not exist. Is this appropriate to send the Hippa letter? This MRI company is a pain..they were even nasty on the day I recieved the service. I would really like it off my report since the debt did not exsist. I have all the necessary documentation that the OC was notified of BK. I have disputed with equifax this morning also. I have worked really hard in cleaning & clearing up my credit, thanks to the kindness and knowledge of good folks like you. What would be the next step? Hippa letter? Thanks again to all, abby
It is the collection agency who is reporting. I have not contacted the BK attorney. Again, 2 months after the BK was discharged. Would it not be the OC's responsiblity to pass along or take back the collection after they were notified of the BK? I have NEVER seen one letter from the CA. I would have hit the roof months ago if I did. I am very careful (obsessed is more the word) about saving everything that relates to my credit and finances. I think I remember seeing a letter that can be sent if someone is continuing to try and collect a discharged debt. I don't remember where I saw it. Hummm, maybe something along that line and Hippa?
