A hospital bill was incorrectly billed/set-up with our insurance co. Ins. co. advised us that not only were THEY not paying but that legally, WE are not required to pay as it was the med biller's own error that made this an uncollectible charge for them. So like over a YEAR later we are advised it has now been sent to a collection agency and I responded (certified, signature card requested, blah blah blah) within 30 days of this notice requesting a full billing and verification (with which to then prove to them AGAIN that we are not responsible for this bill). Two months later with NO RESPONSE from the collection agency I discover that it was reported to Transunion as a collection. Can they do this? Simply fail to respond to a verification request we have PROOF they received and just throw it on our CR?
No, its considered continued collection activity, and is a violation of the FDCPA. Here is an opinion letter on just what you asked: http://www.ftc.gov/os/statutes/fdcpa/letters/cass.htm
You are a credit angel!!! Hmmm... now where do I go from here with this violation??? Off on the hunt. To Arms! Equifax 667 TU 659 Creditexperts "combined score" 654
Re: Re: Medical collections didn't verify I have a letter on my website, linked below, you may find useful. It is titled "Special Letter To H.C.Provider". You will probably need to use insert (b). Here is a direct link as the website is slow tonight. http://community-2.webtv.net/YChallenge/storage/page18.html
Re: Re: Re: Medical collections didn't verify So, are you saying I can use this letter to the original medical provider, to pay the debt and get them to have the CA remove their entry on my CR?
