Hi everyone, I had an uninsured appendectomy at 2am on thanksgiving in 2002. I just got sued for the full amount (~$11,000), and my lawyer is stalling the suit for a few months so I can get my shit together and file bankruptcy. I really don't want to do this, as I believe I can deal with the rest of my debts, if I could get this one down to $2-3k. I'd be willing to do about anything, file countersuits, beg, threaten, etc. I've searched the archives, but there's not a whole lot there..... Thanks T-
Hi, There have been recent changes to the way BK works. Now, if they can show you have the ability to pay back a large portion of your unsecured debts over 5 years they will bump you to chap 13. You could tell the creditors that you are prepared to file BK. You can apply for the hospital's charity program. But in reality, even if they do get a judgement you can make yourself "judgement proof" so they can't touch you anyway. Jane
Hi Jane, thanks for responding. I can easily qualify for chap 7, and although my level of assets is reasonable, they are largely exempt for my state..... T-
You may want to have your lawyer look at the HIPAA regulations and see if they MAY be useful in your lawsuit. I have a HIPAA letter with supporting reference material on my website. In addition, your State may have some additional medical privacy laws in effect.
