This is very interesting. Would memoralization be pointless if the converstaion happened a few weeks ago? Although I did write down the high points I didn't fax it and send it CMRR. Does it have to be faxed and CMRR'ed within a few days of the conversation happening?
Memorialization for the purposes of pinning down agreed actions by the parties in an ongoing negotiation might still be of value to keep a negotiation on course, or to pin down the other party's agreement to, say, pull back an account from a CA, since it was sent there due to a billing or accounting error on their part. If you wanted to use it as evidence in court, they might question your recollection of events, and why your date notarized was so long after the events claimed. You do, however, have your notes which were made at the time in support of the accuracy of your affidavit. Always initial and date your notes when you make them. (I am not an attorney.)
