Merrick Bank

    Requested validation from Merrick Bank and all they sent me was a letter stating that the amt. old matches with my name and ssn. I know this is not proper validation. Which letter should I send off now. Thanks in advance for advice.

    You can go one of two ways. You can send them the partial val letter stating that what they provided was not proper validation and give them 15 days to validate or delete. Or you can send a deletion/intent to sue letter giving them 15 days to delete or you sue.

    Hold up there. Merrick bank is an original creditor and therefore not required to validate under the FDCPA. About all you can do is send them a notice of dispute per rule 623 of the FCRA. They are them required to investigate your allegations and place the acct under dispute with the cra's.

    Thank you both for your recommendations. I will send another letter requesting proper validation. But, I believe they will pretty much send the same thing. I am pulling my credit report to see if they have it being in dispute. Which letter would you recommend sending.
