Merrick Bank

    Merrick Bank has placed over 12 hard inquiries on my CR within 30 days - Finally got them off of 1 CR but they remain on the other 2 CR's as "verified"...? Account is past SOL ... any suggestions on how to proceed? I have nothing to lose by contacting Merrick directly at address on CR but I am in need of outline for letter to send... thanks ;)

    Merrick is a subprime issuer. Sorry this happened to you.

    Are you speaking of the lawsuit SOL or the SOL for reporting?

    I would dispute as obsolete with the CRAs.

    Makes no difference whether the debt is SOL for collections or reporting. Unless there is a Statute of Repose in your state you owe the money. their ability to collect is irrelevant, FCRA gives them PP.

    BUT.... you might have some recourse in suing them for Poisoning your Credit File. Some jurisdictions have bought into this legal theory. Do a lot of research before you start it, though.

    DOLA is 2001 so debt is SOL. Everytime I dispute with 2 CRA's account "verifies" yet 1 CR deleted it!? How can it be PP if I never had an account with them?

    Did you ever at any time apply for credit with them? Perhaps you had an old, possibly charged-off account that they bought?

    If you are 110% sure this is not yours, I would start working on Merrick directly, via mail. If you choose to call, make sure you do not give them your verifying information (i.e. SSN, address, etc) so they cannot change their information to match yours. Make them cough up what they know first.
