Met with lawyer. Here's what I got.

    So I met with a lawyer, paid $275 consultation fee and was basically told that I have grounds to go after both Providian Financial and the 3 CRAs. However, I'm missing critical documents in the form of monthly Providian statements.

    My situation stems from Providian inacurately reporting me late to the CRAs after I signed up with a CCCS in July 2002. Every payment has been made on time by me and then by CCCS. Yes, CCCS is bad news...nothing I can do now but cancel their agreement and try and fix the damage.

    In any case, the lawyer wants me to basically retain him for 3 hours which covers a sequence of "letters (aka ITS) and phone calls." If they can't resolve the issue, they would then move to litigation on a contingency basis.

    Should I try and write my own ITS since I do have every intention of moving on with a law suit should Providian and CRAs not cooperate? And where can I find a solid ITS template I can mofidy to my own needs?

    this is my opinion only from what I have learned about the process.

    in addition to your own ITS letter an attorney gives a formal notification to the other party . seeking one final opportunity for them to comply.

    if they fail the attorney then proceeds, your letters may be good but aren't enough when it comes down to proper notice when filing suit.

    It's been my impression that letters from lawyers get taken more seriously.
