In October, I sent MCM a validation letter. Then after 4 months, they sent me a copy of the application from Discover. I sent them another letter saying that that wasn't sufficient proof of the debt. Now, in today's mail, I get a settlement letter from them. They are in violation, right?

I mean, they offered to settle the account for $783.81 instead of $3135.25. Should I send them a letter saying I'll accept it in return for deletion?

Or should I sue them for violation....

The account is past the SOL to collect.

Yeah they reported a paid collection on flush and it was paid. They are not nice people to work with either.

    Get this one from Midland...

My mother filed Chap 13 (sole filer) and included a joint acct from her and my Step father. The OC was HHB/Orchard....guess what the scums have done..placed the collection on his credit reports although BK Trustee is paying ORCHARD off!!!

    THEY NOT ONLY SUX>>>THEY ROTTTTT!!!

I have been paying Midland for over a year now on a charged off Bank One account.

I set up this arrangement long before I even knew about this site. I haven't had any problems with them, cause of course they deduct my checking account every month for their payment.

Is there anything I can do at this point, or have I shot myself in the foot for paying them.

    I still owe another $2000.

Change your bank acct!!! Ok follow the scenario:

Hi bank lady, my check book has been stolen.
Bank Lady: Ok well you need to complete an affidavit
and we'll just open a new one and close that one.

Now this puts MCM off since they can no longer draft from that acct.

    Then go from there.

I just have thing! I will only pay the OC, no matter how many time they tell me that it's not their acct anymore. Tell a bankruptcy trustee that. Or better yet tell Bank One that they'll only be getting a portion of their money since MCM got paid thru bankruptcy!!! (Boy did you get me hot about them or what?) HAHAHAHA!!!

That sounds like a good idea to close my bank account.

I didn't have a BK though....I was just in a financial mess that I am paying dearly for now!

send the estoppel telling them they've commited a violation and the debt is past its sol. then sue
