Midland Credit - PREPARE FOR WAR!!!

    On 4/8/02, I faxed a letter to Midland Credit requesting validation. Today I received the following response:

    "Thank you for your letter of April 8, 2002 requesting validation of the referenced account. Our records indicate that a judgement was obtained against you on this account. All correspondence should be forwarded to Law Office of ............"

    This is obviously a stall/scare tactic. How should I respond??? Any suggestions??

    NOPE, I've received no communication refering to a judgement nor does it show up on my CR.

    Violation, at the end of 30 days, send estoppel.

    Also send the law firm a letter inquiring about the judgment. They may have tried the "sewer service" strategy to get the judgment. If that's the case, you need to file a motion to vacate.

    I agree with Saar. Credit reports don't always pick up judgements. Be sure this isn't a bluff. Either contact the law firm or, your county courthouse.

    Call the county courthouse today and ask if there was in fact a judgement. Motion to vacate for improper service if there is. See if anything has been filed at all, they may have entered a request for judgement and be lying that it's been approved. That's another violation.

    Thanks, everyone, for the advice. I faxed a modified Estoppel(directly to Midland) last night saying I received your response, but this in NOT the demanded proof/validation that I requested. I gave them 15 more days to send validation.

    Just another "tid-bit" regarding this. Originally, this account was listed on all 3 CR's. EX & EQ DELETED the account after the first dispute, but TU VERIFIED. I have since sent a procedures request to TU. With it coming off of EX & EQ so easily, I'm hoping/guessing that it should be DELETED from TU after a second dispute. Any thoughts??

    I have them on my experiean report everyone took it off...I have no idea who they are I have never received a letter or anything they just say they represent Cross Country bank which I no longer have an account with...can you give me the address and phone of this company I have not been able to find anything on them..

    This is the collection agency that the Associates and its minions used.

    Took a while but disputed them off after about 5-6 tries.

    I think that that's whats going to happen. I disputed this tradeline with all three CRA's. EX & EQ deleted immediately, it TU that's taking their time!
