I've sent Midland Credit Management 2 DV letters which they did not respond to but validated with CRA's. They have a charge off account from FCNB back in 2000. Got a letter today from an attorney stating that Midland Credit Management has employed them to bring about this collection. Is this considered continuing collection activity and what to do. I am sending a DV letter to the attorney tomorrow. I think this is still in SOL for Missouri.
We are having the same problems with Midland. They are also reporting on our credit reports in the "other" catagory,, looking like an installment account that is 120 days late every single month. We sent them two vailidation letters with no responce,, and a letter letting them know that they are not licensed nor bonded in our state. No responce to any of this.. Called the FTC.. they said that it is illegal for midland to post in the "other' catagory instead of the collection catagory... with a collection, it is aged from the date that it opens.. and gets older and further in the past each month... In the other catagory,, it just looks 120 days late, month after month.. year, year after year... never getting any further in the past... The FTC also told us to save all the letters that we have from midland.. they are worth $1000 each in damages. We have created a MIDLAND folder,, and are taking it into the local branch of our state attorney generals office on monday... We need these people gone! They blatently disregard all laws... We have also written letters to the FTC, called and talked to someone ( they said the more that call about midland, the better so make sure you call) So, we will see what happens after talking to the attorney general on Monday and will post back to let you know.
