I need help from someone that understands VA servicing guidelines. Midland Mortgage is servicing my VA loan. The increased my escrow to get reimbursed for a one time charge of forced placed insurance. I replaced the insurance and continued to by my regular mthly payment. There is a $75 difference between the new payment amount and the old. The bottom line is they are reporting me 90 late, even though I have never missed a payment because of the difference. This is wrong in the VA servicing guideline book but the woman at the VA say the Midland does not have to follow the VA servicing guidelines, they are just guidelines. I now just want to remove the 90 day late and pay off the mortgage. They also say they can continue to report the disputed amout to credit agencies even though the VA guideline says not to. Is there an attorney that can advise me of my rights. My credit cards have increased my rates to defualt because of the 90 day posting.
