Has anyone had any dealings with Midnight Velvet and Our Weekends companies. They were reporting on both my TU and EX reports. I disputed because they are not mine. Well, TU deleted both accounts, but EX verified. I did some online research and found that the companies are divisions of Monroe & Main. They appear to be a mail order company. I know that OC's are not obligated to validate, but I sent a validation letter to Monroe & Main and they sent me some type of affidavit for me to fill out and have notarized and returned to them. Should I do this? I know that the accounts are not mine. Are mail order companies allowed to report to the bureaus? I thought that they needed more than a name and address to report.
NEVER sign and have notarized ANY affidavit type of thing. They are reporting on your credit report. They must obviously have SOME information in their records giving them authority to do that. I would file the affidavit with your copy of everything you've done so far (copy of validation letter, CRRR green card if you sent it CRRR) then send them another request for validation. I would let them know that since they've put invalid information on your credit report, they have all the information they need to validate the debt and supply you with proof that the alleged debt is yours. Also did you dispute directly to Midnight Velvet & Our Weekends? It's possible that even thou they're associated with the other company, that they weren't assigned to collect for the parent company. This is for everyone. NEVER SIGN ANYTHING that goes to a collection agency, they can use it to forge documentation to back up their claims. ChrisB
I did dispute directly with Midnight Velvet & Our Weekends, but when I receive any response from them, the letterhead is that of Monroe and Main with the same address for both companies.
These are not CA's. These are the alleged OC's, so they are not obligated to validate, but I will go back to them again requesting more information.
You are sure that you have never opened any kind of account with them, and that this is not your debt. I would write another dispute to them, letting them know that you fear you are the victom of identiy theft, and insist on them giving you a copy of the original contract. If this debt isn't yours and is incorrectly on your report you should be able to get it removed. Unfortunatly the CRA's are buttholes when it comes to this. If you have all the proof, and still can't get it deleted file suit. Keep all copies of everything you've sent them, and if after a few more attempts they still don't validate you can send the CRA letter with your proof letting the CRA know that refusal to delete is allowing identity theft, and no proof of the debt exists and that you've given ample time for Midnight Velvet & Our Weekends to reply. The way I see it, if an original creditor has placed a tradeline on my credit report that I did not open, and I inform them that I feel I was a victim of identity theft, they dang well should feel obligated to provide me with all the information they have, and should track down where the incorrect information came from. If they aren't activly attempting to collect I would just work towards having the CRA delete it after attempting to validate several times and send the proof. Sorry to be repeating myself so much. I would do it. With one exception. Take your pen and strike through your signature one time, straight across the middle. Makes it very tough to copy that onto something else. Besides, OC's don't do that very often anyway. It's the CA's we need to watch out for on this. The fraud affidavit will allow them to make a quick adjustment. It has become common procedure. If you will state in an affidavit that the debt is not yours it allows them to adjust the account and remove it from your CR's. That's what they're trying to do. Why make it overly difficult. BTW - OC's are not required to "validate" but they are required to provide documentation. It's just not called "validation".
