MIL Trouble

    MIL paid off car loan 3 weeks ago.
    2 weeks later mil gets a call from a CA for money past do on the car loan.
    Mil calls CA then Car loan bank.
    Bank tells MIL CA is full of hooey and that they will get every thing straightened out with the CA.
    2 days ago mil gets a letter from the car loan bank demanding the money that the CA was trying to collect.

    IGNORE THE CA...NO CONTRACT WITH THE CA!!!

    MIL will have to work it out with the bank...

    Get a "RELEASE OF LEIN" from the bank...

    Have the bank send a "RELEASE OF LEIN" to the CA...

    Have the bank tell the CA WHERE TO GO!!!

    Good point George. Did MIL (that is in the FAQ's?) get the cleared title yet?

    That's what the bank told her they would do when she called them but they sent her a dunning letter instead.

    She says she got all the paperwork shortly after paying off the car loan.

    Sounds to me like the lien holder was/is playing games with the final payment. If this was an advance payoff (or even the final payment), depending on what part of the 'billing cycle' this occurred in, the payoff amount may only have been good for 7-10 working days after which this amount might not have been sufficient to payoff the newly accrued interest charges!

    I think in simple terms, interest should have stopped accruing on the date that the loan company received/deposited the check - unfortunately for many large companies, this is not always the same date and the delay in crediting the account the final amount may have resulted in some additional interest and that is the amount that the lien holder considers to be in arrears.

    So unless the check did not clear, I think a copy of the cancelled check should be sufficient to settle any controversey. Call and inquire as to what the payoff date was and then reconcile that with the deposit date on the back of the check. If they are not the same - start raising some cain!

    MIL was a customer of the BANK...MAKE THE BANK HELP HER!!!

    They can send another letter...or they can call them again and tell them to BACK OFF!!!

    It's now the bank who is after her instead of the CA.
    Of course one don't know when or if the CA will start in again.

    SO IS IT 100% PAID OR IS IT NOT???

    If she has a "RELEASE OF LEIN" and it is 100% PAID...why are they after her???

    As far as we know it is.
    That's the 64 million$ question.
    The Dealer Ship (DON'T miss THIS one BILL LOL)
    Where she bought the car was shut down last month. by a bank for defrauding the bank(s).
    Wondering if that has anything to do with it

    Were it me... I would go down to bank (or call if not local) with canceled check in hand and plant my butt in their chair until it is all cleared up.
