Mislead by Creditor?

    Hello;
    I have a two part question for you: #1. I acquired a cash loan, (no, not a payday loan) with company A. I borrowed $2600.00, with a high interest rate to pay back. Yes, I know, dumb move on my part! Anyway, about a year into the loan, my husband became ill, and I was not able to make the payments on time every month. I was receiving "threatening" phone calls from employees of this organization. One employee was very hostile while trying to collect two payments from me. Anyway, I was then contacted by their legal dept, and offered a settlement agreement. I was to pay $1462.99 in 6 monthly payments of $243.83. I agreed to this and was told that if I did not keep this agreement, that they would proceed with court proceedings. I could not come up with the $243.83 on three different occasions, and called and spoke with the manager of the legal team, and made verbal agreements to pay a smaller amount, the one month, and then the next month, I would make my regular payment of $243.83, plus whatever was left over from the month before. I as to pay this $1462.99 off by January 30, 2008. I had to split the last payment in half , and again got approval from the manager. I did pay the loan off completely by Feb 15,2008. Once I made that last payment,( I did all of these my money gram) I contacted the manager and asked him if I was completely done. He said, yes you are good, you don't owe us anything else. I asked for a settlement letter, and he told me that it would take 7-10 days to receive that. I never received any written agreement to the orginial settlement, even thought I asked for one. I just paid, because I did not want to end up in court. Is that not my right to request that I have this so called contract in writing?

    Question #2: After they said that I had paid everything, 2 months later I was contacted at work, by another employee of the company A. He stated that I owed $3400.00 and change, and wanted to know if I could pay that today. I explained the settlement agreement I had with their company, and he sadi that he would have to contact them, and find out what was going on. I called him back, and he said that because I did not pay the $243.83 each month, that the agreement was void, and I would have to start over. He gave me another settlement amount this time of $1470.00 over 6 months, and I am paying $245.00 a month now. I again asked for another wriiten agreement with the terms, amount of payments, amount owed, and for it to state that once I follwed all terms, that the loan would be paid in full. He stated that he could not send me anything until I made the first payment. Well, I did and I still have not received anything from them. Do I still have to continue making payments, even if the arrangements are all verbal only? I feel like I am just giving these people my money, and I am not going to go through this again. Can they do this, and do I have any legal rights here at all?

    Sounds like they are jerking you around BIG TIME. I hope that you made all those payments with personal checks, and can print out copies of your cancelled checks to prove when and how much you paid.

    No, I did use checks, but I did use money gram, and I have all of the receipts that said I paid them.

    Looking for any advice here, anyone, please? I live in California, and I'm not sure if I can do anything about this.
