ok, i've been reading the fdcp statutes and this seemed to stand out to me. i have lvnv that has now re-aged an account after i sent them a foad letter. i'm planning on submitting a complaint with the ftc, ag, and bbb. when looking over my old documentation from them, they started out as sherman acquisition, being collected by capital management services inc, then suddenly lvnv "purchased" the debt and was being collected by resurgent capital services. aren't they all the "same" company? can someone guide me to the answer for sure? i want to know before i file my complaints to add that "it is a violation of the fdcp to use anything but its full business name under which it ususally transacts business". the ftc staff commentary reads that when the collector uses multiple names in its various affairs, it does not violate this subsection if it CONSISTANTLY uses the same name when dealing with a particular consumer.
