For those of you that have read my previous posts...we have still yet to close on our home. The original closing date was for 3/27. The house was not complete so we arranged closing for 3/29. Papers were lost by the builder so we were left with no date scheduled last weekend. So this week, lets see, our realtor was to receive papers for our bank from the builders realtor...he didn't show up as scheduled. The builders realtor has been a no-show twice for this paperwork. They told us on Tuesday that they were getting the house cleaned & in "move in condition". We've gone by everyday & this has not been done until today. We are now 9 days past the original closing date...I'm still living out of boxes in my apartment which by the way, I'm having to pay for each day we are still living there. I've canceled delivery of my appliances again for the 3rd time. I swear I'd walk away from this deal but we would lose our downpayment & we just don't have $3500 to just throw away. Is there any legal obligation for the builder to be completed by the day he told us he' d be completed? Can he be held legally resposible for paying for a place for us to live until they get off of their butts & get this thing done? Can I do anything but sit here or does the builder really have the upper hand because we'd lose our money if we walked away?
At this time, you need to contact your realtor and tell him or her to contact the seller's realtor and get their act together. I would be on the phone with my realtor, broker, settlement company, every freakin 4 hours until I got the results I wanted to hear. Tell them you're mad and if something doesn't get done soon you're not only going to report your experience with them to the BBB and never recommend their companies, but if something doesn't take place soon you will take their sorry a$$es to court. There should be no reason for closing to go 10 days behind schedule.
