Ok, I'll try to be short . My current Mortgage company is EMC . I was "bought" by them after UC Lending went bankrupt . That is where the fun started . Anyway , I kept getting 30-60-90 days late payments reported to my file . I would call EMC and ask why to which I would get "We did not report it , you show in good shape , it is the agencies reporting it that way not us " . So , untold times I disputed the file with all 3 agencies . Once the file was deleted from one of the 3 because EMC did not respond . Anyway , most times EMC would report the file as being reported correctly . I for a long time had been finding a address in Alabama on my file and several times had it removed . When I got my "good" job a year and a half ago I had to explain that I never lived in Alabama for my background check to be approved . I got to looking at my stack of paperwork one day and noticed a phone number on the file , a "weird" number . I instantly went to att.com and did a reverse directory look-up and I was FLOORED . The person had the EXACT same NAME as me and lived in Alabama ! I decided I needed to call the guy because I was afraid I was being scammed . I called for a week or so and finally got ahold of the guy . He was/is a back-woods good Ol boy and his name is the same as mine , minus the middle name is different ....... So , as he is shocked that someone has the same name as him we get to talking . I figured where the reports had been coming from so I point blank asked "Would your mortgage company happen to be EMC ?" he replied "Uhhhh .... Yeah ... they are ... EMC is my ... yeah " So , now I figured out EMC was placing his file to mine . At that time I pulled my file(s) again to find one of the 3 had me listed at 90 days for 2 months straight . I disputed all 3 again and the one with 90 days was deleted again completely because they figured out (agency) it was NOT my file . I called EMC ALOT and everytime I got the "Not us , agencies doing it to you" BS . I called them not long ago and got someone on the phone to finally listen . She said "It's obvious your file has been mixed " so I say "Fix it" . She replies "I can't , you will have to call Mr. Suchandsuch but he is not here . He will be back next week and then you can call him . He will send you dispute paperwork out to fill out . Once he receives the paperwork from you , and Id send it registered, he will determine if the file needs a formal review . If he deems it needs a review it will be sent to our review board . If they decide the file is in error , they will make a judgement and have the file corrected and the agencies will receive a updated file." I told her "That seems like alot of hoops for me to jump through since Ive been trying to get this fixed for so long" . She said "It's all I can do for you" So , I told her "Are you recording this phone call ?" she replied "Yes" I said "Well , then let me inform you that I refuse to be made to jump through hoops to fix the problem you created . If I must jump through hoops I would rather sue you and let your lawyers fight it out with a judge . So , if you will not fix this now ... I am going to file a suit against you for slandering my credit ." Of course she told me to do so if I felt I needed to . I found out who thier "Agent for Service of Process" is and picked up small claims court paperwork . What do you guys think I should do to arm myself better for the fight ? Thanks .
If you try to re-finance, you will at least be able to determine how much damage they are doing to you. Since interest rates have been heading higher, any negative reporting may cost you higher rates even if they eventually correct, if their error delays your ability to refinance at current rates. Make sure your paperwork is in order on your disputes to both CRAs and the mortgage company, since at this time you don't know whether a suit will be necessary to actually clear it up. The more blatantly you can document their incompetance and failure to correct the more likely they will want to settle. It might be worth a final written demand that they correct immediately, summarizing the complete history of your attempts, including the CRAs verifying with them. Make it clear that this has gone on long enough, and damages are accumulating.
I received my results again from a dispute from Experian and that the results will stay . Transunion deleted the account a long time ago because it was in error and I assume EMC did not answer . Im going to draft a letter and mail it certified to EMC stating what they have done to me and letting them know if they don't remove the errors on my report and verify the correct customer before adding anything else to my account that I will file a suit .
