Is there a legal way or letter you can send the credit reporting agencys that the way they have posted a 30 day is illegal and has to be removed? I have a sister that was responsible to make the payment and she was doing so until last month when she had and NSF check and wasn't notified in a timely manner to take care of it. Now the bank BofA is not willing to send a letter saying that they sent out a letter to let her know. Needles to say i have a mark on my credit that i need to get rid of. HELP!
She wrote an NSF check to B of A for a mortgage? IMHO, you may not have much of a leg to stand on, because they didn't notify you in a timely manner. It would be her responsibility to not write a bad check in the first place. The payment was late, but you might try a goodwill letter.
I second Flash's opinion - it's not the bank or lender's responsibility to let your sister know she bounced the check. I'd be interested in knowing whether a goodwill approach would work, as I have some legit lates on one of my mortgages too. Good luck Poochie
