Motion For Summ Judgment

    I file a lawsuit against a company and my court date is due on May 12, yesterday I received a copy of the MOTION. how do I answer this?

    did you file the lawsuit or did the company file against you? The reason why I am asking is because when a Motion for Summary Judgment is filed usually the defendant has filed an answer to the Petition and a hearing is set for all parties to meet and present their evidence before a judge prior to a judgment being taken. If the defendant did not file answer to the petition then the plaintiff can move for a default judgment. Normally if you are the plaintiff you would be the one to file the Mtn 4 SJ unless they filed a counterclaim. Please advise.
