I recieved a Motion For Summary Disposition from the court. Its for a Old Providian Account. Great Seneca Financial Corp purchased the account. Rausch Sturm, Israel & Hornik, S.C is the attorneys trying to collect. I have been collections letters from them, they have nearly doubled the balance. What is a Motion For Summary Disposition? Thanks
As best as I can tell, they want to get a judgement against you without appearing at trial. You need to look into the process for your state, and make sure that you comply with the process in its entirity. Or they could get a judgement against you for the full amount, even what may or may not be 'legal' fees.
http://www.courts.state.nh.us/rules/scr/scr-25.htm Not sure which state you are in, but I googled on Summary Disposition, and pulled up the NH rules (some other states came up as well, so if you search for it on Google you may come up with your states rules)
