Just had a new little CA join my collection of CA negs on my CR. Now I have the same debt reported by three seperate entities. My ? is this: If I dispute with the other two, since this new CA seems to hold the debt, does that mean they will not be able to validate? Or at least shouldn't be able to? Weenies! Any guidance out there? TIA, K
Now, are the three listings you are referring to only CAs, or 2 CAs and the OC. If you dispute the account with the CRAs, any CA which no longer has the account should fall off, but the OC can still report the account. How the OC reports depends on how they 'hired' the CA, if the CA is just assigned to collect, then the OC can report it with a balance. If the CA sold the account to the CA, then the OC can report it with a zero balance, and usually marked with "Account Transferred or Sold" or similar verbiage. The fact that it keeps getting moved around is a good indicator that for whatever reason either they don't want to work for it, or they can't find the documentation to fullfill the validation request.
So if they all get verified (no OC just 2 Ca's) what's the strategy? Validation to all and to all a good night? or is there something specific that might support the notion that you can't owe two people the same debt! (I've put this question elsewhere but instead of starting a new thread I'd thought I'd jump on an oldie... still seeking...)
Oh I forgot... What if the most recent CA has sent a print out of the assignment "we offer you the account listed below for collection on the basis of .40 net to you of all amounts collected. do not sue, employ no attorney, nor make any compromise unless authorized by claimant." Does this mean it's been passed off and no longer belongs to the first CA? Can I use this "against" the first CA to question how they are verifiying this with the CRAs? Hmmm
Know what I do in cases like this 3Day? If the OC still owns it, I make a HUGE deal out of it and then blame it all on the OC. "YOU WEENIES HAVE THIS THING SO SCREWED UP THERE'S NO WAY TO EVEN KNOW WHO TO PAY, EVEN IF I WANTED TO". .
Somewhere I saw a "conquer and divide" letter designed for placing the CA against the CRA. What about using this tactic against 2 Ca's reporting and verifying the same debt? Hmmm... Also, does anyone know where I might find this template? TIA
