Multiple CA FDCPA violations

    tboy, you are right, date opened is not the same as date of last activity. However reading the original post, if some of the accounts were from '96, they should have fallen off by now, unless the date of last activity was December of '96.

    Ahh ok ... question: what is the difference between date opened and reported since? on my TL for AFNI, it says that the date opened is 7/2002 and reported since 5-2000 .... is it possble for "reported since" to be earlier than date opened?

    Yes, if the TL was originally reported by the OC, then assigned/sold to the CA.

    The reported since date would be the first time it was reported, the opened date is the date the CA got the account. Hope I didn't muddy that up too much.

    all i have to say to those of you who stiff your debtors and turn around and sue over petty issues is i hope they don't pay YOU if your able to get a judgment.

    and to the poster who said 7 trades reaging is abuse - yeah your right, but the abuse was caused by the debtor, and now he's upset because he can't get away with it and is SO eager to jump on the suing bandwagon to make a buck. teach a lesson to the oc/ca? yeah, thats right, they'll never do that again, will they?? i can't wait until you go into court and say i didn't pay but what THEY are doing is wrong. unless you ACTUALLY have a better defense than that, good luck in winning.

    just remember, what goes around comes around.

    i'm off to find a credit board with SOME morals.

    Does this mean you can't provide us with information about how much taxes we pay for these cases and how much this really affects interest rates and premiums?

    Darn the luck. I was hoping to be "enlightened."

    I'm curious -- using your morality arguments, why was it ok for you to get around payiing the debt that was yours?? you realize that not paying debts are in the same catergory of lawsuits and charge-offs that you claim are driving up costs?

    Now you are just being ignorant. The underlying debt was caused by the debtor, not the ILLEGAL activities of the CA. Are you saying comitting illegal acts is a position of moral superiority?

    Gib, no problem on the hi-jacking... it needed it! I thank you for keeping to the point. I'll be writing my validation letters today, thank you for the advice.

    I do understand what JenZ is saying to a point. I know there are people out there searching for loopholes to screw someone else. But that is not me. That's where I take offense. I thank the competence of those who replied, taking the issue at hand and answering it for what it is.

    People, hard working American citizens who pay too much in taxes and with little "real" representation in the Legislative branches of government, must suffer for 7 seven years - even after paying off the debt. Thanks a lot!

    Folks who are laid off their jobs at no fault of their own or who are required to pay very expensive medical bills because they can't afford the very expensive health insurance often suffer because of the very awkward, unfair and ambigious credit scoring-reporting system that we must deal with.

    We are fighting back, not because we are scum or criminals. We fight back because the Enron-minded corporate dealers and wheelers could care less about out plight or circumstances. We want a level playing field and wish to be judge by where we are today as opposed to where we were 5 years ago.

    Thank god someone else is having these same problems. My husband helped is mother purchase a car which she couldn't pay for due to help problems later(1996). We already had two car payments, kids, etc... to take care of and we were strapped. He contacted the finance company and explained the situation. The reposessed the car and said it would go on his credit as a voluntary repo.

    Since then Jaywhawk went belly up in 1997 and the account was sold in 01/2003 to Ameristar. On the TU report it shows the date the account was opened and the updated date of 01/2003. The experian report shows nothing. Now let's jump to Equifax. It shows the account belongs to Pro-Collect and the date of last activity is 03/1997. Is anyone following this fiasco?

    It took me 3 weeks to get through to what's left of Jayhawk. After several phone calls I found out the account has been sold 4 times total. The company that now owns it is Camco Financial, which is showing no where on his reports. The lady I spoke with at Camco said North Carolina has issued a cease and desist order against them and revoked their business license. Legally they can't contact anyone living in N.C. or try to collect from anyone here either.

    So what freaking date do I go by? I mean this is ridiculous. It's like any company that contacts the CA's get to put anything they want against anyone.

    Oh, and the addresses listed? It's got addresses in states neither my husband or I have ever lived in! What's up with that?

    In the process of doing that now! I hoping to hear something soon. I know this is ridiculous! Companies just report stuff and nothing is ever verfiied.

    Has anyone had any trouble with Marlin Integrated Capital?

    You mean one where they agree with you that customer ought to pay creditors and CAs but it's ok for the CAs and creditors not to pay consumers for violating the consumers rights.

    Oh please! Are you suggesting that everyone on this board doesn't pay their bills and then sues to get out of it? Number one I know that bill thru Marlin isn't mine or my husband's. Neither of us have done business with the "OC." And their are other inconsistencies on our reports, you know like addresses we've never lived at. Even states we've never been in! Identity theft is a huge issue these days so I wouldn't start pointing fingers and accusing people of having "no morals" unless you know the whole story.

    I tell you guys what. Let's all (everyone that has a SSN basically) let the CA's and the CRA's put whatever they want on our credit and pay for it continously. Let's make them richer and us poorer. (NOTE MY SARCASM HERE!)
