The guy called my mother's house looking for me , he left a message on my machine . "this is mr otoole with Pacesetters I would like to talk about your letter . there are a few issue we need to talk about, a few isssues you don't understand. then gave his number" What is there to not understand. I sent them the estoppel letter 31 days after the validation letter!! They diddn't respond the first time. I want to call him back and see what he wants. May be he would tell me I need to pay of something. But I get upset easily. I don't want to loose my mental bearing. Should I call him back or just wait for their response?
Screw him. That's a stall tactic, hoping that you don't really understand your rights and will backtrack under the verbal rigamole he plans to put you through if you call back.
Save the message! Send a letter to Pacesetters CRRR stating that they have FAILED to validate the listing. That they have abused your rights further by contacting a 3rd party (your mom) about the debt. That you received a message from an agent during the FAILED validation period where they neglected to respond, clearly in contradiction to the FDCPA which states that all collection activity must cease unless and until proper validation is supplied (state that you have the message on your answering machine as evidence of the call/time/and date). And that they have completely ignored your rights under the FDCPA. As such you are giving them 72 hous to delete all listings with all CRA's that this listing was reported to, or you will see them in court, where you will most assuredly be adding another violation for this outrageous phone call and one more for contacting a 3rd party about the account. If they know what is good for them they will immediately delete. -Peace, Dave
