Much to my surprise when I pulled my credit report earlier last year I discovered not one but two negative comments on my credit report. I thought surely this would be an error as you had never contacted me about these checks before. I was under the opinion that before you placed a negative entry in my credit report you were required to contact me. I am sincerely sorry you did not receive payment for these checks for such a long time. Had I have been informed of the issue you may be assured that you would have been paid promptly. When you did notify me of the issues in a letter informing me that as soon as my checks cleared your account both accounts would be removed from my credit. I faithfully sent in my checks and waited anxiously for the marks to be removed from my credit. Instead of honorably removing them from my credit file you placed a further negative comment in my file: paid collection. This was not what you promised. I sent you those checks trusting in your honor and honesty to faithfully fulfill the terms of your letter. I really hate to have to threaten this but it really angers me that you lied to me. I have the original letter from your company promising that the accounts would be deleted from my credit file and I am not afraid of suing you to fulfill your written obligation to delete these accounts. I sincerely hope this matter will not have to come to this and you will honor the promise made to me in your collection letter. I will be filling a suit for breach of contract and violation of the FCRPA on March 2nd, 2003 should I not hear from you before then. Sincerely, How does it look? Would you mind posting the letter the CA sent you which contained this promise? I'm curious as to the wording they used.
My Paid Collection Letter?SUCCESS! I couldn't find the letter however good news.... Here is their letter: Dear Mrs. Hoyt Thank you for your letter. It appears that you may have moved and changed your name about the time that the checks were sent to us for collection. We did send out the appropriate notice at the time the checks were written, but they were returned as bad address. We tried to find a new phone number and since your name had changed, we couldn't find the number. However since you did pay the checks when you found out about them, and you never received the first notice, we can delete them off your credit report. I will send the fax to the credit companies today to delete them. If you would, would you fax me the letter we sent you advising we would delete them? My toll free fax number is 1-888-714-6022.
