Don't stop payment with them, and DON'T CALL. Call your bank and stop payment there. It will probably cost you a fee. One reason kyle1979 said be patient and read a lot before you do anything. THE END ** *** ** LB 59 """"```--~~~~~~~~~--```'""'''

Re: Re: My Repair Starts... I may be mistaken lbrown59, but I thought I read elsewhere on this board (or maybe another one) that there are certain things that do restart that clock. Wasn't sure if paying was one of them, but I thought it was.
You have a lot goin on here Theossie. I assume then that you wrote postdated checks? Does the CA send a letter letting you know that they will be cashing your PD checks? ??
You should take your paid off accounts and dispute with the CRA's. Try to do 2 or 3 at a time. If the stats hold up about half will fall off. Then we can go to work on those that remain. The above question about the post dated checks is important. By law they are required to "remind" you by letter on post dated checks. For those debts with which you already have made agreements, I'll think about those over night and get back tomorrow. In the meantime, you'll want to have a separate thread for each account. It keeps the rest of us from getting confused and you get focused advice. Don't worry about not understanding something, we're a patient bunch. Just keep askin until you get it. Also read your butt off. Start at the "Hall Of Fame" threads at the top of the board. Welcome to the board. .
NCO sent me a letter about the post dated checks.. The "Offices of Mitchell N. Kay" didn't. Thanks for joining Butch.. I will post new threads for each of my accounts.. I'll leave the two collection accounts in this one since that has been the only topic so far. I appreciate all this guys.. Theossie
Re: Re: Re: My Repair Starts... You did. But it don't apply to Ca collection accounts. Perhaps someone else will chime in and explain it better than i could.
Since I talked to NCO and I've been paying on them since June.. I also made an agreement with the other company on settlement... I've called both to stop and stop both payment with my bank.. but doesn't that hurt validation stragedies... I may be confused, but is that what Marie said I few times in the "NEVER deal w/Collection Agency" thread.. It was the older part of the thread, but it was never debated when people recently posted??
I've read all the threads you suggested LB.. Very interesting.. My head's spinning a little lol.. but I have a basic idea of how it works.. Thanks..
Paying a debt doesn't reset the seven-year reporting clock, but it can reset the SOL. Once you make a payment, but don't bring the account current, you haven't restarted the seven-year reporting clock. Paying it off or settling it does not bring it current, unless it's a revolving account that is still open. But the SOL for them to collect the debt is an entirely different issue, and that's what may restart.

Re: Re: My Repair Starts... Did you ever claim responsibility for any debt in writing? If you did, it might not be the end of the world, but it would probably hurt a little. When you get right down to it though, most of the time, whether a ca validates or not is not neccessarily based upon how much proof they have that the debt is yours, rather, it's more based on how accurately they've kept records, how they follow procedures, and how lazy they are. And again, if validation fails, the #1 thing you have going for you is that you have money, and they want it. The ca would be stupid to pursue any legal action against you, because to garnigh your wages they'd have to secure a judgement, and the legal fees that would entail are enough to cancel out the money they'd collect. This is one of the few times in life where it's better to be the little penniless consumer than the large, powerful corporation....
