Thought I'd put in my .02 here. Don't worry that you've made some payments. Validation is not just about proving the debt is yours, but it is also about proving that the CA has the right to collect it
thank you all for the posts.. I've mailed that letter off.. I wasn't getting any replies after kyle told me about the short letter.. so I sent it.. and I had the "my" in it. oh well..
BankFirst: Paid/Current, was part due 120 days. 1*Account was closed by BankFirst. It has been paid off since like June 01 2*Discover: Closed Fingerhut Corp: Collection. $199 past due as of 5-01. This account has been bounced from one collection agency. 3*This account will be paid soon.. since I took a 50% settle offer this month. 4*First USA Bank: Paid/Account charged off. I paid this account March 5* 2 MBGA/JC Penney It will be paid off at the end of November. 6*Both these account was in collection with NCO. I've been paying on the first one and haven't been paying the other. NCO Financial: Collection account. 7*This was a medical bill. I paid it this month.. They said they don't send settlement letters, and it should update within a month. 8*And last but not least. Providian Financial: Account charged off/Past due 150 days. It's been bounced to different collection agencies.. 9*I'm currently not paying on it. 10*I was told that Amex cards are the hardest to get, and if that's true then my goal is to get one. 11*Then I can be confident that my credit is in good shape. Ok guys I need advice on this.. As you can see earlier in this thread I made an arrangement for settlement with NCO, then I called and canceled the arrangement.. It was originally arranged for settlement in two payments of 212.50 each by check..one at the end of Oct, and one at the end of Nov. Like I said earlier in the thread.. I called them on the 29th on Oct. and told them to cancel the payments.. I mailed them I validation letter CM /w RR, and they received it on the 17th of November.. Ok today I see they cash a check for 212.50 on the 28th of Nov. (it posted yesterday) and I didn't have the money so my account is overdrawn half that amount. So I need you quys help.. I did make the arrangement and I canceled it... then I sent validation.. Did they mess up, or am I stock out cause I made the arrangement.. I'm thinking this is continued collection.. but not sure... I also didn't receive an letter or call from them about the validation nor the check being deposited.. Help please IWB
Of course it's continued collection. At this point it's all in your favor IW. You have numerous violations. If you owed it, I'd leave it paid, and use their violations to force deletion. You're in good shape. .
This one jumps out at me, and since my math says its a $400 debt, I think I might just go to an ITS: (2) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit. Gee, I bet you didn't get anything reminding you of such so that you could cancel.
You're right Jodi. She said there was no "reminder". Somehow tho, we have to resolve the debt part of the problem. Suing the CA, and even winning in court doesn't make the debt disappear. IWB, might be able to sue and get the money back. But now that they have it it would be tough to get it back. Kinda like paying the IRS and then suing for a refund, yeah right. lol Right? ??? OH - if IWB really doesn't owe it then hell yeah, I'm with you. . .
Nope I didn't get a reminder... I do owe it, so I should use their voilations to get deletion.. but they sure messed me up by making my account overdrawn... I've also got an update about the other CA I mentioned in this thread... I got a letter from them today with the following.. This is in response to your recent communication. We have noted your file and will cease further collection activity. Accordingly, we are closing our file in this matter and will return this account to our creditor Any questions regarding your credit report should be addressed to the creditor as we do not report to the credit bureaus in any form or fashion. them depositing that check got me $128 in fees.. I'm all messed up financially at the wrong time of the year
