    HI all,

I need to contact the president or CEO of Sears. I am so angry I could spit nails. My brother is learning disabled, and has an account with Sears. He sent a check and they misread the numerical portion. They cashed a check for 601.45 when it should have been 60.45. I sent a letter on his behalf, and they assured me the problem would be taken care of. They said the money was deposited back in his bank account. That hasnt happened, and they now have the gall to assess late charges on his account! (A previous rep told him the money would be applied as a credit to his account.) I didnt want him to do that, since this check pretty much wiped out his bank account, but at this point I just want it to show up somewhere. Its like someone pocketed it. I sent copies of the canceled check, the bank statement, even their letter saying the situation was resolved (it wasnt) and the statements showing the late charge. They wont talk to me on the phone at all, and he cant call since he is at work during the day without access to a phone, and has a speech disability. I sent numerous faxes and letters, and they just dont care. They hang up on me when I call, or keep putting me on hold. I need to send a letter to the CEO, dont know where else to go, except a lawyer. They owe him the money, or the credit, with interest. I dont even want the credit, since he is closing the account after this, but at this point I just need the money to be found. Sorry so long, anyone know the name of the CEO? Thanks

What a bunch of jerks! Please consider also raising a bit of cain with Sears National Bank (the people who administer the card). These numbers aren't generally provided to the public, and I can't remember now how I came across them:

    Sears National Bank
    2626 S Hardy Dr.
    Tempe, AZ  85282
    Telephone 1: 480-804-5600
    Telephone 2: 480-804-6300
    Telephone 3: 480-804-5608

Good luck to you and your brother!

    Doc

Thanks Freeze and PsychDoc! I appreciate your help. Im going to call now and get a fax number so I can send this stuff over today.
It makes me so mad, my poor bro has been humiliated throughout this, and he doesnt have the greatest self image as it is. He takes such pride in paying this bill on time, and managing it himself. Boy, I am gonna send a letter to the association for handicapped citizens, and whatever branch of the state that are advocates for the handicapped. I told them in the first letter that he was left with zero funds after their mistake, and they never even so much as called him. I hate for him to think he is being made a fool of.

Thanks again for your help. (Boy its true when a redhead gets mad watch out ! :)

Well, I called an attorney and he will handle this for @ $100. I called Sears, they refuse to give me a fax number for the CEO (a manager there actually laughed at me and said "no one here is gonna give you that number." So, I am done. But, if I end up filing suit, they better get ready to pay up the original overpayment, the interest, and a little extra for all the time I have spent trying to resolve this.

One reason they are probably not talking to you is because you are not authorized on his account. Have you sent them a legal Power of Attorney? I'm sure that Sears management would not want their representatives speaking to customes like that. I would call the number 1-800-917-7700 and ask to speak with a supervisor once you send them your legal Power of Attorney. If you do not have that then you need to get one so you can speak on your brother's behalf.

I can't see SEARS keeping the money...

When I had a real low limit at SEARS, I over paid the account so I could buy a VERY EXPENSIVE ITEM on one of those 10% off days...when it came time to do it...the sale was DENIED...

LONG STORY SHORT...THEY MAILED ME MY REFUND WITH-OUT ASKING...SO I NO LONGER HAD A CREDIT BALANCE...(they wanted me to "APPLY" for a limit increase)
    I DON'T THINK SO!!!

I walked out with-out any MAJOR purchase...deposited the check and didn't use the account for a couple of years...

Thank you everyone, so much! George, that info is great, I am getting in touch today. I agree that they wont speak to me because I am not on the account, but I have called them with my bro right next to me. They speak to him long enough to authorize me to get involved, then the games begin. They put me on hold, transfer me all over, etc. Regarding Sears not wanting their service people to treat customers that way, I can only assume its a company wide attitude and is tolerated. I have spoken to too many people who either flat out refused to help me, or, when I told them I was going to a lawyer, said *okay.* I work in a service related industry and if someone threatened to go to the CEO, it was a call for alarm! We did all we could to stop it, and if it did get that high, we would be counseled by management over it. I guess it doesnt work that way at Sears. And the funny thing is my brother has phenomenal credit. He is so proud of taking care of his financial stuff, I hate to see this get him down. ANyhow sorry so long, I will let you all know how it works out and where this mystery check went!

Go after them and sue! I am steaming mad for him. My blood pressure was going up reading this.

I hate sears with a passion!! My mother is elderly 70+ years old. She pays all of her bills on time. She gave me the money to pay the account balance - I did. But there was some stupid insurance on the account that my mother never noticed and it was billed for 3 months and charged interest and late payments.

I sent them a CRRR letter citing the Fair Billing Act and followed up with a phone call after I got the Green card back.

The CSR was very rude until I spoke with a Supervisor. She was nice and charged the amounts back to the insurance people and reversed all of the charges and late payments. I'm still waiting to see if this has updated on her account.

Sears has a reputation of trying to take advantage of people who can't fight for themselves.
