Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS Are CAs like CBCS (OH), PARK DANSAN (NC), NCO (PA) and AFNI (IL) typically legal in all states or does it make sense to check them. I am in California. Do they have to be legal in both states or is it enough for them to be legal in California (my state).

Re: Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS ALWAYS CHECK ON EVERY CA!!!!! Please...don't take the CA's word for anything or assume anything!!!! You will b surprised!!!! Please, please, never call a CA and ask them. Go to the state itself! There are other things to check for...like if they are licensed, have they been disciplined before..if they have...your complaint on the same violation will draw attention!! Also....check often on them even if you find nothing...their license may expire or become suspended and you'll want to jump for dispute if that happens!! I suggest (honestly) checking your licensed standings on CA's online once every week or two. For instance, In CO, a CA can be disciplined and it posted giving you a 10 day window to dispute while they are "out of the biz" for those 10 days.
Re: Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS this information is great. however, I've read everything I can (here and at creditboards) followed the links, directions, etc. and I havent been able to find much for my situation. I'm in MO (no license or bond required here) and the CA (sherman) is in TX ($10,000 bond required.) I've been to lawdog, TX state site, TX AG site, Sec of State site. I've clicked on everything that may have something to do with this, but I can't find anything about collections and bonding. oh, i did a search here on 'sherman', 'bonded' and 'licensed' also. Lots of great info on sherman here, but nothing about whether theyre bonded or not. does anyone know if they're bonded in TX? thanks!
Re: Re: Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS In order to verify bond requirements in Texas: Verification of Bond or Complaints (By Telephone or Email, no online) Nina Weston at (512) 463-6906, or on the internet at nweston@sos.state.tx.us. If you email today, you'll have an answer by tomorrow.. Good luck!
Re: Re: Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS wow Nana...you're on the ball! I actually emailed there yesterday. I'm waiting for their reply, but I'm so darn impatient, i thought i'd ask here while i waited, just in case they didn't email me back. I hope they're as quick as you say. i'm so bad about waiting. thanks so much!
Re: Re: Re: Re: Re: Re: Re: Re: NEW COL CA BOARD LAWS She will email you back..very likely tomorrow. Only once she didn't in one day and that was because she was out of office one day. I've emailed in the AM and gotten an answer in 30 minutes..she's amazing! They are! But, the holidays may impact things, of course. And, sure..glad to help!
Re: Re: Re: Re: Re: Re: Re: NEW COL CA oh my gracious. I was going to plaster what i just read over there, but on second thought, i think maybe I should celebrate this quietly. :::doing happy dance::: ahhhhh. it WILL be a happy new year. Trent, you just made my freaking day. THANK YOU!
Re: Re: Re: Re: Re: Re: Re: NEW COL CA oops. upon reading a little more closely, it seems they CAN legally collect in my state, just not in TX. Someone tell me i'm wrong. please.
Updating "More Thinking" Some more thinking no this: 1. Warning: DO NOT accept the word of the CA in this situation! Do NOT call them and ask them if they are legal/bonded/licensed! (I SUGGEST YOU NEVER CALL A CA FOR ANY REASON!) Find out for yourself if they are legal to operate as a CA in the state in question! 2. Professional courtesy is one thing but I would not overexplain the situation to them. You don't owe them anything...they are ILLEGAL!!! They need to grab both CA butt cheeks and haul rear end away from you and their CA attempts. 3. There have been some questions about the validation w/state illegality letter and the reason I combined them....in my humble opinion and experience, by combining this, they get completely overwhelmed. First, you found them out, then you want them to put on paper their attempt to collect by a validation request? If they are stupid enough to send the validation request back in ANY form, you have proof of full-fledged collection activity! They are making your case stronger and stronger! 4. When doing state searches for CA's, be aware of variances in the CA name which could result in false info..for example, if you are searching for CFC, you will want to check "CFC" and "Commerce Funding Corporation." In fact, I would just type in "Commerce" so I get a complete listing of any biz with "Commerce" in its name.
Re: Re: Re: Re: Re: Re: Re: Re: Re: NEW COL Nana, I think trent thought I was you in that last post about 'celebrating quietly', and he wanted to know what was meant by that. I'm not trying to be all 007 here, but I didn't know whether or not to post what I'd read here in the forum all 'out in the open'. I'm just paranoid, lol. I don't want 'them' to know that I know. even tho they're already very aware of what I now know. oh sheesh, I'm not making sense, lol. its all here. anyhow, i read it way too fast, and got all excited for nothing, i'm afraid. Nana, if a CA is in a state that requires they be bonded, and they're NOT, can they legally collect in a state that requires no bonding or licensing?
Re: Re: Re: Re: Re: Re: Re: Re: Re: NEW COL Tell me the state they are in, Crow, and I'll go find out what I can.. Thanks for the clarification, too!!!
Re: Re: Re: Re: Re: Re: Re: Re: Re: NEW COL they're in TX. Its Sherman Acquisition. Nana, you've done so much already. really. you don't have to research anything else for me....i think i've pretty much beat this dead horse long enough. ive found out lots of stuff, but since i'm in MO, i don't think any of it will apply in my situation. I'm still waiting for that email from the AG office btw. the lady auto-responded that she's out of the office til the 5th. I'll let things go until then. thanks again for all your (and everyone elses) help! i just simply need to know if they can collect in my state even tho they're not bonded in the state they're 'based' in. I'm thinking they can. which gets me really discouraged, and makes me do things like beat dead animals, lol. maybe i'll try emailing MY states AG? thanks again!
