there is no time limit when you can ask for validation, ask for it, what's the worst thing that can happen to you ? beat you up ? no, ask for validation, send it cmrr, and wait, and keep track of any collection activity by W & A while you are waiting for validation.
Now please tell me what that thread has to do with debtchoked, yes debtchoked can still request validation (One never loses that right) but where does it say that collection activity must cease if validation is requested after the first 30 days. If its in that thread please point me in the right direction. Beeman ================ A VERY CAREFUL, technical read of 809 (B) reveals that all it says is you may not expect the CA to cease collection efforts, until validation is provided, if validation arrives after the 30 days. ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~~~ ><- <>- ><- <>
maybe i do not understand the law lbrown, let me see if i am understanding you correctly, a CA can continue collection activity (furnishing information to the CRA's, file a law suit, call you on the phone, send dunning letters, etc.) if they receive the validation request AFTER the initial 30 day period. what is the incentive for a CA to ever validate a debt after the first 30 days, if i were them i would just ignore the validation request and it is business as usual. why even give you the right to ask for validation after the first 30 days if, according to you, there are no penalties on the CA to not provide it.
maybe i do not understand the law lbrown, 1*let me see if i am understanding you correctly, 2*a CA can continue collection activity (furnishing information to the CRA's, file a law suit, call you on the phone, send dunning letters, etc.) if they receive the validation request AFTER the initial 30 day period. 3*what is the incentive for a CA to ever validate a debt after the first 30 days, 4*if i were them i would just ignore the validation request and it is business as usual. 5*why even give you the right to ask for validation after the first 30 days if, according to you, there are no penalties on the CA to not provide it. billt1227 *********************************** 1*I don't think you are understanding me correctly. Why I don't know! 2*According to hiding 90 yes. 3*There wouldn't be any. 4*Right it would be a green lite for them. 5*Exactly there would be no purpose in it. However this is according to hiding 90 not me. I don't comprehend why you're attributing it to me. ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~~~ ><- <>- ><- <>
lbrown stated, *809(b) reveals that all it says is you may not expect the CA to cease collection efforts, until validation is provided, if validation arrives after the 30 day window* sorry, but 809(b) says nothing about consumer expectations, is this your opinion ? butch has said in his validation thread, *if the consumer does not request validation within the first 30 days, but does so later, the CA cannot assume the debt to be valid*.
debtchoked, you have been on your quest with MBNA and W & A since 8/03 are you interested in doing anything or are you looking for absolute proof and rules before you do anything. you went to a lawyer and you thought he was a jerk, i thought you stated you used this attorney before. i am tired of giving advice and no response. good luck in whatever path you choose.
Re: Re: National Arbitration Foundation And I agree with butch.I miss read the following and should not have quoted-MY BAD. * 809(b) reveals that all it says is you may not expect the CA to cease collection efforts, until validation is provided, if validation arrives after the 30 day window*
